Data Licensing Policy

Scope of Licence

Subject to your active subscription plan and full compliance with these policies, MarketXY grants you a limited, non-exclusive, non-transferable, revocable licence to access and use MarketXY Data solely for your internal business or research purposes.

All rights not expressly granted in this Policy are reserved by AllHeart Web Inc. No licence is granted by implication, estoppel, or otherwise. The licence does not transfer ownership of any data, database rights, or intellectual property to you.

Permitted Uses

• ✓Search, view, and analyse domain names, categories, company data, and metadata using the MarketXY web interface and/or API
• ✓Export data in permitted formats (CSV, JSON, Excel) within your plan's export limits, for internal use
• ✓Enrich internal CRM, SIEM, or business intelligence systems using MarketXY data via authorised integrations
• ✓Conduct internal sales intelligence, cybersecurity assessments, brand protection, market research, or competitive analysis
• ✓Use exported data for internal academic studies or government/regulatory compliance purposes
• ✓Access the API to build internal tools that consume MarketXY data — subject to API rate limits and fair use policies

Prohibited Uses

• ✕Reselling, sublicensing, distributing, publishing, or transferring any MarketXY data or derived outputs to any third party
• ✕Building, training, or enhancing any competing domain intelligence product, API, service, index, or database using MarketXY data
• ✕Including MarketXY data in any public-facing product, SaaS application, dataset, or API accessible by parties outside your organisation
• ✕Using MarketXY data to train machine learning or AI models for commercial products without a separate written AI Training Licence
• ✕Scraping, automating extraction, or systematically bulk-exporting data beyond plan limits
• ✕Storing or replicating MarketXY data for the purpose of public or third-party use
• ✕Claiming ownership or authorship over any MarketXY output, category structure, or scoring methodology

Ownership & Intellectual Property

All Data, Parsed Data, algorithms, category models, scoring systems, database structures, and associated content available through MarketXY are the exclusive intellectual property of AllHeart Web Inc., protected under applicable copyright, database rights, trade secret, and trademark laws.

The MarketXY name, logo, platform, and all associated branding are trademarks of AllHeart Web Inc. and may not be used without prior written permission. Third-party data included in MarketXY's services is subject to its respective data provider licences; MarketXY asserts database compilation rights and selection copyright over the organised output.

Derived Works

You may create internal analytical outputs, reports, and enriched datasets using MarketXY data, provided these remain for internal use only and are not redistributed. You may not:

• ✕Replicate the MarketXY category model, scoring logic, or database structure in any derivative application
• ✕Use MarketXY's category taxonomy or methodology to build a competing classification system
• ✕Publish or share derivative works externally without a separate written licence from MarketXY

Enterprise Data Licences

Organisations requiring rights beyond the standard licence — including data redistribution, white-labelling, AI/ML training, multi-site deployment, full database access, or bulk category exports — may apply for an Enterprise Data Licence Agreement.

Enterprise licences are negotiated individually and may include: custom usage volumes, extended redistribution rights for specified purposes, higher API throughput, dedicated support, custom SLAs, and Data Processing Addenda for GDPR compliance. Contact [email protected] to begin the process.

Audit Rights

MarketXY reserves the right to audit your use of the Services to verify compliance with this Data Licensing Policy and the Terms of Use. Audits may be conducted remotely via API usage analysis or, with reasonable notice, through a request for documentation. You agree to maintain accurate records of your data usage and provide reasonable cooperation during any audit.

Enforcement

Violation of this Data Licensing Policy may result in immediate suspension or termination of access without refund, legal action for damages and injunctive relief, claims for unjust enrichment, notification to affected third-party data partners, and referral to relevant authorities. MarketXY reserves the right to seek compensation equal to the commercial value of data used in excess of the granted licence, including lost licence revenue.
